How we work, what you get, and what we both agree to — written plainly. Full agreements are available for download at the bottom of this page.
We ask for a 50% deposit before production starts. This confirms your booking and secures your dates. The remaining 50% is due upon completion and before release of the final files.
No final files are released until full payment is received. We accept KES, USD, EUR, CHF, and other currencies by prior agreement.
Travel costs outside Malindi and Watamu are charged separately and agreed in writing before the shoot.
You receive the final edited and graded deliverables as agreed — video files, photographs, or both — delivered via our online platform.
RAW files, project files, and unedited footage are not included unless separately agreed in writing and remain the property of IMARA Film. If you need physical media (USB / SD card), let us know before the shoot — an additional cost applies.
Preview images or teasers may be shared during production but do not count as final delivery.
We keep the raw material for 1 year after delivery. Within that year, a re-edit can be quoted. After that, we archive only the exported deliverables, for up to 10 years. Archives sit with third-party cloud providers, so keep your own copy of everything we deliver.
Copyright in all material produced by IMARA Film stays with IMARA Film. Once you have paid in full, you receive a licence to use the delivered material for the purposes agreed — personal, professional, social media, website, internal use, screening, and presentations.
Use in paid advertising, television broadcast, cinema advertising, or paid media campaigns requires separate written agreement. You may not sell, sub-licence, or significantly alter the delivered material without our written consent.
IMARA Film may use selected final material for portfolio, website, social media, festival, award, educational, reference, and self-promotional purposes, unless specific restrictions are agreed in writing before production commences. We will fully respect any such agreed restriction.
Where the production is a music video, you warrant that you own or have licensed the musical recording, composition, and any other third-party content used. IMARA Film is not responsible for copyright claims, Content ID matches, muting, monetisation, or takedowns arising from the music on any platform.
The visual work is licensed to you for public distribution of the commissioned music video across online and social media platforms — YouTube, Spotify, Apple Music, TikTok, Instagram, and similar platforms — tied to the commissioned track. Paid advertising, television broadcast, cinema distribution, or sublicensing requires separate written agreement unless included in the agreed scope. IMARA Film retains the right to share the complete music video publicly for portfolio and promotional purposes.
Where the production involves filming or photographing artworks — including paintings, sculptures, installations, or murals — copyright in the artwork remains with the artist or rights holder, entirely separate from the copyright in the film or photographs produced by IMARA Film. We make no claim over the copyright in the documented artwork.
You warrant that you have obtained all necessary permissions from the artist or rights holder to commission the documentation and use the resulting material for the agreed purposes. IMARA Film is not liable for any copyright claims arising from the reproduction of artworks in the delivered materials.
One revision round is included unless your package includes more. Revisions mean reasonable adjustments within the agreed scope — not a new creative direction, full re-edit, or different music. Additional revisions can be arranged at an extra cost.
If you do not request revisions within 14 days of delivery, the work is considered accepted.
For photography delivered via selection gallery: if you do not make your selection within 14 days, our first selection counts as your selection and is delivered.
If you cancel after production has started, the deposit is non-refundable.
If you cancel before production starts, the deposit can be applied to a rescheduled date within 90 days. If no new date is agreed within that time, the deposit is forfeited.
If we cancel for reasons within our control, your deposit is returned in full without undue delay and in any event within 5 workdays.
In all cases, any costs already incurred and services already delivered up to the date of cancellation are deducted from any refundable amount.
IMARA Film's total liability under any agreement is capped at the amount you paid for the project.
We are not liable for any indirect or consequential losses — including loss of profit, loss of business, loss of data, or reputational damage — regardless of how they arise.
Drone operation depends on weather, wind, visibility, safety, and Kenyan aviation regulations. If we cannot fly on the day due to conditions outside our control, no drone surcharge is applied. All other agreed services remain unaffected.
Live streams are delivered via Vimeo and can be simulcast to YouTube, Facebook, LinkedIn, Instagram, and other RTMPS-compatible platforms. The stream is automatically archived and shared with you via a private link.
Stream quality depends on on-site internet, power, and platform availability. We take all reasonable precautions but cannot guarantee an uninterrupted broadcast where conditions are outside our control.
If music or content played during the event triggers copyright detection on third-party platforms, any resulting muting or takedown is outside our control. You are responsible for ensuring event content is properly licensed.
AI sits inside the tools we edit with. In Lightroom and DaVinci Resolve it denoises, masks and stabilises what the camera recorded: a better algorithm, not a different picture.
Where AI generates rather than assists, we name it. Today that means voice-over, which is generated rather than spoken; real estate photographs, edited with a tool built for property; and generated material in a film, such as transitions, backgrounds, thumbnails or music. The tools will change. The rule does not: whatever we generate, we tell you.
In your footage, AI completes and improves what we recorded. It does not invent what we did not record. We do not add people, objects or events that were not there. On property shoots we remove clutter that is not part of the property: bins, cables, a parked car. We do not remove what is part of it. Damage, wear and the view from its windows stay in the picture.
Voice-over is generated, not spoken by a person. The voices are licensed for commercial use, including advertising and client work. In English, Swahili, Italian and German we direct the take. In a language we do not speak, you supply the script and you approve the take before we deliver. If you prefer a human voice actor, we quote that separately per project.
Where you publish material we made or edited with AI, any disclosure your market or platform requires is yours to meet. We will tell you what was done so that you can.
By working with us, you confirm that all people appearing in the production have given their consent to be filmed, photographed, edited, and delivered. Where minors appear, you confirm that appropriate parental or guardian consent has been obtained.
We use secure, encrypted cloud storage for production and delivery. We do not share or sell your material to third parties.
Any permits, access fees, or authorisations required for filming at the agreed location are your responsibility. We will advise where we know restrictions apply, but obtaining and paying for permits is on your side.
If we cannot deliver due to circumstances genuinely beyond our control — extreme weather, illness, civil unrest, government restrictions — we will inform you without delay and work with you in good faith to find a resolution.
These terms are governed by the laws of Kenya. Any disputes are subject to the jurisdiction of the Kenyan courts. All agreements must be in writing — verbal agreements are not binding.
By booking our services, you agree to these terms. They apply in full unless a separate written agreement has been signed by both parties.
